New law shields timberland owners from permit fees for logging roads

Congress passes legislation to allow EPA to continue the silvicultural non-point source exemption on logging roads in the Pacific Northwest. Under this legislation, there is authority for EPA to extend for another year its policy on logging roads. The result is that landowners will not have to get federal NPDES permits for harvests on their properties and logging companies will not have to develop stormwater control systems. This relates to a recent Ninth Circuit Court decision that overturned long-standing EPA Clean Water Act policy where silvicultural activities were exempt from stormwater permitting.
