Following action by the US District Court in Washington DC to remove the stay on the implementation of Boiler MACT rules by EPA, the Director of EPA Lisa Jackson sent a letter to Senator Ron Wyden, in response to his request on what action EPA would take following court action, indicating that the US EPA "will not enforce any of the administrative requirements for new or existing boilers and incinerators in the 2011 Rules for a period of time while the EPA works to take final action on the proposal to reset these dates”. This is good news for the many industries who will be impacted by the new rules. But the action is only temporary. Attached is the letter that Director Jackson sent to Senator Wyden.
